Payment & Billing

Disclaimers

Acceptable Use Policy

This Acceptable Use Policy describes prohibited uses of the AI CRM Manager platform. Violations may result in immediate account suspension or termination.

Prohibited Activities

  • Send unsolicited commercial messages (spam) or violate anti-spam laws
  • Harass, threaten, or harm any individual or group
  • Distribute malware, viruses, or other harmful code
  • Impersonate any person or entity
  • Collect or harvest data without proper consent
  • Engage in deceptive marketing or fraudulent activities
  • Violate any applicable laws including privacy and consumer protection regulations
  • Send messages to individuals who have opted out or requested no contact
  • Use the platform for illegal gambling, adult content, or sale of controlled substances
  • Attempt unauthorized access to our systems or other user accounts

Messaging Standards

All SMS, email, and other communications must comply with applicable regulations including the TCPA, CAN-SPAM Act, and CTIA guidelines. Proper opt-in consent is required before sending any marketing messages.

SMS / Text Messaging Policy

Effective: January 1, 2025

AI CRM Manager enables users ("Senders") to send SMS and MMS messages through the platform. This policy governs all text messaging activity and applies to all account holders.

Consent Requirements

All SMS communications must comply with the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. Senders must obtain prior express written consent from recipients before sending any marketing text messages.

Required Opt-In Disclosures

  • The name of the program or business sending messages
  • The types of messages to be sent
  • Message frequency (e.g., "Msg frequency varies")
  • That message and data rates may apply
  • How to opt out (e.g., "Reply STOP to unsubscribe")
  • How to get help (e.g., "Reply HELP for help")

Opt-Out Compliance

Senders must honor all opt-out requests immediately. Recipients may opt out by replying STOP, CANCEL, UNSUBSCRIBE, END, or QUIT. No further messages may be sent after an opt-out except a single confirmation.

Prohibited Message Content

SMS messages may not contain SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco), phishing attempts, malware links, deceptive content, or any content violating our Acceptable Use Policy.

10DLC Registration

Senders using 10-digit long code (10DLC) numbers must register their brand and campaigns through The Campaign Registry (TCR) in compliance with carrier requirements. Unregistered traffic may be filtered by carriers.

Data & Privacy

Phone numbers and consent records must be stored securely. Consent data must be available upon request and retained for a minimum of 4 years. Opt-in data shall not be shared with third parties without additional consent.

Refund Policy

This Refund Policy outlines the terms under which AI CRM Manager may issue refunds for platform subscriptions and services.

General Policy

All subscription fees are generally non-refundable. We do not offer refunds for partial months of service, unused features, or cancellations made after a billing cycle has begun.

Exceptions

  • Duplicate charges caused by a billing error on our part
  • Platform outages exceeding 72 consecutive hours during a paid billing period
  • Other circumstances at our sole discretion

Cancellation

You may cancel your account at any time by contacting your authorized partner or our support team. Cancellation takes effect at the end of the current billing period. No partial-month refunds are issued upon cancellation.

Platform User Requirements

TCPA Compliance Policy

Consent Requirements

Prior express written consent is required before sending marketing text messages or making marketing calls using an automatic telephone dialing system (ATDS) to mobile phones. Platform users are responsible for obtaining and documenting valid consent.

Consent Documentation

Users must maintain consent records including: time and date consent was obtained, phone number consented, exact opt-in disclosure language, and collection method. Records must be retained for a minimum of 4 years.

Do Not Call Registry

Users conducting outbound telemarketing calls must scrub contact lists against the National Do Not Call Registry and maintain an internal do-not-call list.

Opt-Out Handling

All opt-out requests (STOP, CANCEL, etc.) must be honored immediately and permanently. Users must not attempt to circumvent the platform's opt-out mechanisms.

Liability

Platform users who violate TCPA requirements are solely responsible for resulting fines, penalties, or litigation. AI CRM Manager reserves the right to suspend accounts found in violation.
